Although the Torrens system of land ownership was introduced in the Cayman Islands only in the early 1970s and is intended to be straightforward by comparison with its British counterpart, rapid development has led to increasing complexity. We provide the expert guidance necessary to avoid the increasing number of pitfalls that that complexity brings.
We undertake investigations to enable the client to understand the nature and extent of the title being acquired. We negotiate contracts with a view to requiring the counterparty to give the interest in land which our client expects, and to provide a real remedy in the event of breach. We attend to the mechanics of registration and completion. We seek working relationships with key Government agencies so as to facilitate compliance with ever increasing regulation; this has become particularly important in areas such as planning and the environment.
